Terms of Service
Effective Date: 09 July 2026 Last Updated: 09 July 2026
These Terms of Service ("Terms") govern access to and use of EasyWaitlist, a waitlist hosting
and management platform operated by Thomas Webb, trading as EasyWaitlist ("EasyWaitlist," "we,"
"us," or "our"), a sole trader based in the United Kingdom.
By creating an account, accessing, or using EasyWaitlist (the "Service"), you agree to be bound
by these Terms. If you do not agree, do not use the Service.
1. Who These Terms Apply To
These Terms apply to:
- Customers - businesses and individuals who register an account with EasyWaitlist
to create, host, and manage waitlists ("you," "Customer").
- End Users - individuals who sign up to a waitlist hosted through the Service. If
you are an End User, your relationship is primarily with the Customer who created that waitlist;
see our Privacy Policy for how we handle your data as a processor on their behalf.
2. Description of Service
EasyWaitlist provides tools to create, host, and manage waitlist pages, including collecting
sign-ups, analytics, and related features (the "Service"). We host waitlist pages and store
associated data on behalf of our Customers.
3. Eligibility and Accounts
- You must be at least 18 years old, or the age of legal majority in your jurisdiction, to
create an account.
- You must provide accurate, current, and complete information when registering.
- You are responsible for maintaining the confidentiality of your account credentials and for
all activity under your account.
- You must notify us promptly via https://easywaitlist.dev/support of any unauthorized use of
your account.
4. Acceptable Use
You agree not to use the Service to:
- Collect sign-ups for unlawful, fraudulent, or deceptive purposes.
- Upload or collect special category data (e.g., health, biometric, religious, or political
data) without our prior written consent and appropriate safeguards.
- Send spam or unsolicited communications to End Users beyond what they consented to when
joining a waitlist.
- Infringe the intellectual property, privacy, or other rights of any third party.
- Introduce malware, attempt to gain unauthorized access to the Service, or interfere with its
operation.
- Use the Service to build a competing product by way of scraping or reverse engineering.
- Misrepresent your identity or affiliation, or impersonate any person or entity.
We reserve the right to suspend or terminate accounts that violate this section.
5. Customer Data and Content
- Ownership. As between you and EasyWaitlist, you retain ownership of all data you
submit and all data collected from your End Users through your waitlists ("Customer Data").
- License to us. You grant EasyWaitlist a limited license to host, process, and display
Customer Data solely to provide and improve the Service.
- Your responsibilities. You are responsible for ensuring you have a lawful basis
to collect and process End User data via the Service, that your waitlist pages carry appropriate
notices/consent mechanisms, and that your use of the Service complies with applicable data protection
law (including UK GDPR, EU GDPR, and other applicable regimes). If required, you agree to enter
into a separate Data Processing Agreement with us governing our processing of End User personal
data on your behalf.
- Export and deletion. You may export or delete your Customer Data at any time through
your account, subject to reasonable technical limitations. Upon account termination, we will delete
or anonymize Customer Data in accordance with our data retention practices, except where retention
is required by law.
6. Fees and Payment
- Certain features of the Service are offered on a paid subscription basis. Fees and billing
cycles are described at [Pricing Page URL] and/or in your order confirmation.
- Payments are processed by Stripe, Inc. ("Stripe"). By subscribing, you agree to Stripe's terms
of service and authorize us to charge your chosen payment method on a recurring basis until
you cancel.
- All fees are exclusive of applicable taxes unless stated otherwise. You are responsible for
any taxes arising from your use of the Service.
- Except where required by law or expressly stated otherwise, fees are non-refundable.
- We may change our pricing on notice of at least 30 days. Continued use of the Service after a
price change takes effect constitutes acceptance of the new pricing.
- Failure to pay may result in suspension or termination of your account.
7. Free Trials
If we offer a free trial, it will convert to a paid subscription at the end of the trial period
unless cancelled beforehand, as specified at the time the trial is offered.
8. Intellectual Property
The Service, including its software, design, branding, and underlying technology, is owned by
Thomas Webb or his licensors and is protected by intellectual property laws. Nothing in these
Terms grants you any right, title, or interest in the Service except the limited right to use it
as permitted here.
9. Third-Party Services
The Service may integrate with third-party tools (e.g., Stripe for payments, Google Analytics
for analytics, Oracle Cloud Infrastructure and Cloudflare for hosting and delivery). We are not
responsible for the acts, omissions, or terms of third-party services, and your use of them is
governed by their own terms.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether
express or implied, including implied warranties of merchantability, fitness for a particular
purpose, and non-infringement. We do not warrant that the Service will be uninterrupted,
error-free, or completely secure.
11. Limitation of Liability
To the fullest extent permitted by law:
- EasyWaitlist shall not be liable for any indirect, incidental, special, consequential, or
punitive damages, or loss of profits, revenue, data, or goodwill.
- Our total aggregate liability arising out of or relating to these Terms or the Service shall
not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or
(b) £100.
- Nothing in these Terms limits liability for death or personal injury caused by negligence,
fraud, or any other liability that cannot be limited or excluded under applicable law.
As a sole trader, you should be aware that this limitation of liability clause protects the
business relationship with Customers but does not itself shield your personal assets - that
depends on your business structure and insurance, not on this document. You may wish to
discuss appropriate professional indemnity or public liability cover with an insurer or
adviser.
12. Indemnification
You agree to indemnify and hold harmless EasyWaitlist and Thomas Webb from any claims, damages,
liabilities, and expenses (including reasonable legal fees) arising from your use of the
Service, your Customer Data, or your violation of these Terms or applicable law.
13. Term and Termination
- These Terms remain in effect while you use the Service.
- You may terminate your account at any time via your account settings or by contacting us at
https://easywaitlist.dev/support.
- We may suspend or terminate your access if you breach these Terms, fail to pay applicable
fees, or if we reasonably believe your use poses a risk to the Service, other users, or us.
- Upon termination, your right to use the Service ceases immediately. Sections that by their
nature should survive termination (e.g., IP, disclaimers, limitation of liability,
indemnification) will survive.
14. Changes to the Service or Terms
We may modify the Service or these Terms at any time. Material changes to these Terms will be
notified via the Service or email at least 14 days before taking effect. Continued use after
changes take effect constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law
principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute
arising from these Terms or the Service, save that we may seek injunctive relief in any
jurisdiction to protect our intellectual property or confidential information.
16. Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy and any DPA, constitute
the entire agreement between you and EasyWaitlist regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions
remain in full effect.
- No Waiver. Failure to enforce any provision is not a waiver of our right to do
so later.
- Assignment. You may not assign these Terms without our consent. We may assign these
Terms in connection with a sale or transfer of the business.
